Federal Court Rules Women Are Second-Class Athletes

The three-judge panel of the 2nd Circuit Court of Appeals ruled against the young women seeking fair competition in sports.

The young women, Selina Soule, Chelsea Mitchell, Alanna Smith and Ashley Nicoletti (all track athletes), along with their mothers, were hoping to have the Connecticut state policy that allowed transgender students to compete in women’s sports overturned.

This war on women and their place in society has been ongoing for years, and was dealt a harsh blow with the Court of Appeals affirming a lower court’s decision to throw out the young women’s case.

For the court, it wasn’t enough that the victories these women would have earned were taken instead by biological males.

“Like the district court, we are unpersuaded, with respect to the claim for an injunction to alter the records, that Plaintiffs have established the injury in fact and redressability requirements for standing; both fail for reasons of speculation,” the judges ruled.

But this outcome the Circuit Court passed had been planned years in advance.

As reported by the Daily Wire, the Supreme Court case in 2020, where the Supreme Court stunningly ruled that Title VII was interpreted to include protections for transgenders and other members of the LGBTQ community, was also a basis for the Circuit Court’s ruling. The Supreme Court’s decision meant that the Civil Rights Act is interpreted as prohibiting discrimination based on gender identity as well.

Chief Justice John Roberts and Justice Neil Gorsuch sided with the court’s liberal judges in the decision.

And there were warnings about this exact situation happening. People knew the Court’s 2020 decision would harm women and have opportunities stolen from them. But the Supreme Court did not listen.

All in the name of inclusivity.

While the young women who have lost out on collegiate opportunities due to losses to biological men are disheartened, the Alliance Defending Freedom who represented them is looking at all available options.

“The 2nd Circuit got it wrong, and we’re evaluating all legal options, including appeal,” ADF senior counsel Christiana Kiefer said. “Our clients—like all female athletes—deserve access to fair competition. Thankfully, a growing number of states are stepping up to protect women’s athletics.”

In a move that shows the direction the American Civil Liberties Union (ACLU) has shifted, they praised the Court’s decision to harm the future generations of women growing up in America.

“The court rejected the baseless zero-sum arguments presented by the opposition to this policy and ultimately found transgender girls have as much a right to play as cisgender girls under Title IX,” said Joshua Block, senior staff attorney for the ACLU’s LGBTQ & HIV Project. “This critical victory strikes at the heart of political attacks against transgender youth while helping ensure every young person has the right to play.”

But the women who brought this case forward never wanted people who identified as transgender to not play. They want them to play with other biological men.

One’s social views do not cancel out the reality of the biological difference between men and women, especially in relation to sports.

Now, with statements such as Joshua Block’s, women are considered secondary and their rights simply are not as important as a transgender’s.

This is not how God intended men and women to interact with one another. He designed each and every human on earth with a purpose and in the correct body.

He did not design men to replace women or vice versa, but to live in harmony with one another, each serving unique purposes for which He designed them.

This type of court decision is only going to continue as long as rulings such as the 2020 Supreme Court decision remain in place.

Christians must pray for, fast for and elect government officials who will stand up for God’s design and His values in America. If not, the road ahead will be filled with crushing losses in the court system when people try to stand up against the tyranny of the world.

God can heal this nation, but to do so Christians must put their faith into action.
